	PHOTO CREATIONS PLUS AFFILIATE AGREEMENT Please read carefully! To be an authorized affiliate of PHOTO CREATIONS PLUS, you agree to abide by the terms and conditions contained in this agreement. Please read this agreement carefully before registering and using the PHOTO CREATIONS PLUS Affiliate Program. By signing up for the PHOTO CREATIONS PLUS Affiliate Program, you indicate your acceptance of this agreement and its terms and conditions. Sections 1. AFFILIATE AGREEMENT 2. COMMISSIONS 3. AFFILIATE AGREEMENT This agreement describes the terms and conditions for participation in the PHOTO CREATIONS PLUS Affiliate Program. The terms "Affiliate," "you," and "your" are referring to you, the applicant. "We" and "our" refer to PHOTO CREATIONS PLUS We are independent parties and this agreement will not form any partnership. This agreement will begin upon our acceptance of your affiliate application and will end when terminated by either party. Termination may happen at any time, with or without cause, by giving the other party written notice of termination. By posting a Change Notice or a new agreement on this site, we may modify any of the terms and conditions within this Agreement at any time and at our sole discretion. If any of the modifications are UNACCEPTABLE TO YOU, your only recourse is to terminate this Agreement. If you CONTINUE PARTICIPATION IN THE PROGRAM following the posting of a Change Notice or new agreement, it will be considered as your acceptance of the change. 2. COMMISSIONS When you join the PHOTO CREATIONS PLUS Affiliate Program you receive a unique ID number and special Affiliate Link which you may promote. When visitors come to our website by clicking on your Affiliate Link, a special "cookie" is stored on their computers with your affiliate ID. This is how your sales and commissions are tracked. PHOTO CREATIONS PLUS agrees to pay you commission at the current percentage rate for each sale that results from a visitor clicking on your Affiliate Link. For a sale to generate a commission, the customer must complete the PHOTO CREATIONS PLUS order form, remit full payment and have their order shipped. Any returned checks, chargebacks, or fees from returned orders will be subtracted from your next commission payout. You will also receive a percentage of the commission from any of your sub-affiliates you have sponsored into the PHOTO CREATIONS PLUS Affiliate Program. WARNING: You MAY use your affiliate link to make purchases for yourself, but MAY NOT combine discounts or coupons AND your Affiliate Commission. Only one type of discount/commission per order can apply. You MAY NOT sign yourself up as your own sub-affiliate to generate a higher commission percentage. Any affiliate caught doing this will be immediately terminated from the Affiliate Program and forfeit any commissions owed. Commissions will be paid monthly via PayPal. A PayPal account is not required to participate in the PHOTO CREATIONS PLUS Affiliate Program but it is preferred. If you do not have one, I will write and mail you a check. PHOTO CREATIONS PLUS, may, from time to time, offer special commission rates to individual affiliates, at our sole discretion. 3. ORDER PROCESSING PHOTO CREATIONS PLUS will be solely responsible for processing every order placed by a customer through the Affiliate and sub-affiliate links. Customers who purchase products through PHOTO CREATIONS PLUS Affiliate Links will be deemed to be customers of PHOTO CREATIONS PLUS. Prices and availability of our products may vary from time to time. PHOTO CREATIONS PLUS policies will always determine the price paid by the customer. We reserve the right to reject any order that does not comply with our rules, operating procedures and policies. 4. WEBSITE RESTRICTIONS PHOTO CREATIONS PLUS reserves the right not to accept any site into our Affiliate Program based on site content at our sole discretion. Sites that DO NOT QUALIFY include sites that promote sexually explicit materials, violence, discrimination, illegal or questionable activities, violate intellectual property rights, use or encourage SPAM (UCE). 5. SPAM - Unsolicited Commercial E-mail (UCE) PHOTO CREATIONS PLUS in no way participates in mass unsolicited e-mailing (i.e. spamming), and all Affiliates are expected to adhere to this policy as well. Violation of this policy will result in the termination of this contract and immediate dismissal from the PHOTO CREATIONS PLUS Affiliate Program and forfeiture of any commissions owed. 6. DISCLAIMER We make no express or implied warranties or representations with respect to the Affiliate Program or your potential to earn income from the PHOTO CREATIONS PLUS Affiliate Program. In addition, we make no representation that the operation of our site or the Affiliate Sites will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions, errors or down time. 7. DISPUTES In the event of a dispute, the parties agree to submit the matter to the Community Dispute Resolution Service or any recognized Arbitration Board located within Portland, Oregon, before instituting litigation. By submitting this Affiliate Agreement form, you acknowledge that you have read this agreement and agree to all its terms and conditions. You have independently evaluated this program and are not relying on any representation, guarantee, or statement other than as set forth in this agreement.
